Inter-Country Adoption - Eligibility

Marital Status

  - A couple married for 5 years or a couple with at least 5 years’ of a stable relationship.

  - Single persons (never married, widowed, divorced) up to the age of 45.

  - Same sex couples are not eligible to adopt.


Age

  - The composite age of the prospective adoptive parents will not exceed 90 years. Also, in no case shall the age of any
     one of the prospective adoptive parents exceed 55.

  - Single persons (never married, widowed, divorced) up to 45 years.

  - The age difference of the adoptive parents and child should be 21 years or more.

  - A FPAP in no case should be less than 30 years and more than 55 years.


Financial Status

Reasonable income to support the child should be evident in the Home Study Report and supporting documents.


Health Status

Health status indicative that the adoptive couple have no health problems.


Second Adoption

A second adoption from India will be considered only when the legal adoption of the first child is completed. The Adoption Rules require that a child placed in inter-country adoption will be legally adopted in the receiving State not later than two years from the date of the order.
