STATE GOVERNMENTS - DEPARTMENT OF WOMEN AND CHILD DEVELOPMENT
The State Governments/ Union Territory, is the authority that will license/recognize Indian adoption agencies for in-country adoption. From amongst such agencies, the State Government may recommend agencies for handling, in addition, Inter-country adoptions. Such applications seeking recognition for inter-country adoptions are forwarded by the State Government, to the Central Adoption Resource Authority.
The State Government maintains lists of all agencies handling in-country and inter-country adoptions. It also, maintains a list of all children who are declared legally free for adoption by the competent authorities in these institutions.
The State Government :
- Monitors the adoption program and the activities of all adoption agencies, RIPAs & ACAs within its jurisdiction.
- Encourages and promotes placement of children in adoption or guardianship with families within the country.
- Enforces the provisions of the Orphanages and Other Charitable Homes (Supervision and Control) Act, 1960 and/or
Juvenile Justice (Care & Protection of Children) Act, 2000 and / or formulates suitable alternate rules, to ensure that
certain minimum standards for childcare are maintained in the agencies.
- Recommends to CARA, renewals of agency- licenses.
- Forms an Advisory Committee on adoption to oversee child welfare.
- Periodically inspects all licensed agencies and monitors their performance.
- Initiates appropriate legal action against persons and institutions including Nursing Homes and Hospitals involved in
illegal adoption work.
The department of Women and Child Development, in the State Government looks after the function.
